  • Use the site for any unlawful purpose or in breach of any applicable law or regulation
  • Interfere with or disrupt the operation of the site or any networks or systems connected to it
  • Attempt to gain unauthorised access to any part of the site, user accounts, servers or systems
  • Use automated tools to scrape, harvest or collect data from the site except where this is allowed by law and clearly permitted
  • Use content from the site in a way that misleads, deceives or suggests sponsorship, endorsement or affiliation that does not exist.

The site is provided for personal and organisational use in connection with information, research, education, commentary and debate about public affairs. Any wider commercial use of the content requires prior written permission from us unless an exception under Australian copyright law applies.

2. Editorial content and general information

Content on Kenwyatt.com.au is produced for general information and journalism purposes. It does not constitute professional advice, including financial, legal, medical or other specialist advice.

While care is taken in preparing material, we do not guarantee that all content will be complete, current or free from error. Policies change, markets move and new information emerges. Decisions about finances, employment, health, legal matters or other significant issues should not be based solely on material from this site. Independent advice from a qualified professional should be sought where appropriate.

The presence of a person, organisation, product or service in a news report, analysis piece or other content does not imply endorsement.

3. Independence and name

Kenwyatt.com.au is owned and operated independently. It is not owned by, affiliated with or endorsed by Ken Wyatt, the former Australian Minister for Indigenous Australians, or by any political party, government department, corporation or lobby group.

Any similarity in name is coincidental and does not indicate a relationship. All rights in the site’s content, name, logo and associated branding are held by the publisher, subject to any rights that may subsist in material provided by third parties.

4. Intellectual property

Unless otherwise indicated, content on Kenwyatt.com.au is protected by copyright and other intellectual property rights under Australian law and relevant international agreements. This includes text, images, graphics, audio and video content, logos and the overall design and layout of the site.

You may:

  • View the site on your personal devices
  • Print or save reasonable portions of content for personal use, research, study, criticism or review
  • Share links to content using standard web and social media tools.

Any reuse of substantial parts of content, systematic copying, republication, framing or distribution in another service or publication requires prior written permission from us unless a statutory exception applies.

Where material from third parties is used under licence or as fair dealing, those rights remain with the relevant rights holders.

5. Contributions, submissions and comments

From time to time, material may be submitted to Kenwyatt.com.au by email or other channels. This may include news tips, documents, commentary, opinion pieces, photos, audio, video or other content.

By sending material for possible publication or incorporation into our journalism, you:

  • Confirm that you have the right to provide the material
  • Confirm that, to the best of your knowledge, the material is accurate and lawful
  • Grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, edit, adapt, publish and communicate the material in connection with our journalism and related activities, in any format and through any media now known or developed in future
  • Acknowledge that we are under no obligation to publish or use any material that is submitted.

We may edit or moderate submissions for legal, editorial or space reasons. Material that is defamatory, discriminatory, hateful, threatening or otherwise unlawful may be rejected or removed.

If interactive or comment features are offered in future, additional rules may apply to those services.

6. Third party content and links

We may include content or links relating to third party sites, products, services or publications. These may be included as part of reporting, analysis, advertising, sponsorship or general information.

We do not control and are not responsible for the content, security, privacy practices or availability of external sites. Inclusion of a link or reference does not constitute endorsement or approval. You access third party sites at your own risk and should review their own terms and policies where relevant.

Any third party content displayed on the site, including advertisements, sponsored material or embedded media, remains the responsibility of the third party involved.

7. Availability, changes and maintenance

We provided on an “as available” basis. We aim to maintain access but do not guarantee that the site, or any part of it, will always be available, uninterrupted, secure or free from faults.

We may, at any time and without notice:

  • change, update or remove content
  • modify the design or features of the site
  • suspend or discontinue parts of the site for maintenance, upgrades, security or operational reasons
  • restrict access to some or all users where necessary for legal, security or operational reasons.

We are not liable for any loss arising from changes to the site or from any temporary or permanent unavailability.

8. Disclaimer and limitation of liability

To the fullest extent permitted by law:

  • all representations, warranties and guarantees relating to the site and its content, whether express or implied, are excluded
  • we are not responsible for any loss, damage, cost or expense suffered in connection with the use of, or reliance on, the site or its content, including any indirect or consequential loss, loss of data, loss of profit or loss of opportunity.

Nothing in these terms excludes, restricts or modifies any consumer guarantees or other rights that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation. Where liability cannot be excluded but can be limited, our liability is limited to the fullest extent permitted by law.

9. Your responsibility and indemnity
